California Lemon Law


Under both the California Lemon Law (also known as Song-Beverly Consumer Warranty Act) and Federal Law (also known as Magnusson-Moss Warranty Act), you have legal rights if your vehicle does not perform as expected under the manufacturer’s express warranty.

In other words, when you buy or lease a New, Used or Certified Pre-Owned Vehicle and the vehicle has a defect that substantially affects the vehicle's use, value or safety, then Lemon Law offers you protection by offering legal remedies to have the defective vehicle repurchased or replaced if the manufacturer or authorized dealership cannot repair the vehicle's within a reasonable number of repair attempts.

Lemon law offers protection if you have bought or leased your vehicle. In addition, your vehicle can be new, used or certified pre-owned.

What Are You Entitled To If Your Vehicle Is A Lemon?


Refund or Replacement

If a car is a lemon, the law provides several options for a successful Lemon Law claimant. You may be awarded a replacement vehicle of the same year, make, and model OR you may qualify for a refund which is a monetary award. The monetary award can include:

  • The full contract price
  • Sales tax or license tax
  • Registration fees
  • Finance charges paid on your loan
  • Incidental costs such as repair or expenses, tow fees, car rental fees and
  • Attorney fees

On most instances, you are free to choose whether to accept a refund or replacement vehicle.

Attorney Fees Are Paid By The Manufacturer

The California Lemon Law includes an attorney’s fees provision, which allows our office to collect our hourly attorney’s fees from the automobile manufacturer at the successful resolution of the claim. This makes pursuing a California Lemon Law claim economically feasible for those who would otherwise not be in a position to hire an attorney. If nothing is received, there are no legal fees.

Repair/Service Orders


Do not be discouraged if you’re repair/service order does not show a problem with your vehicle. Even if your repair order doesn't show that a service technician found the problem that you brought the vehicle in for, doesn't mean that the problem doesn't exist, or that your vehicle isn't a lemon. It could just mean that the mechanic may have simply missed the defect. In fact, most of the time, certain make or model may suffer from a known uniform problem that the dealership's service department does not yet officially recognize exists because manufacturer has yet to discover a "fix" or redesign for the vehicle's defect. Instead, the service writer may write "could not duplicate" or "vehicle operating as designed" on the repair order and allow you to drive away with a potentially dangerous vehicle.
